Photography service terms

General terms for services by Jakub Plšek. A specific proposal and signed agreement prevail where they differ.

1. Provider

2. Enquiries and contract

A website enquiry or initial proposal is not a binding order. A contract is formed by accepting a specific proposal in the manner stated there or by signing an agreement. A wedding date is reserved only after the contract and agreed reservation payment, normally at least CZK 4,000. The payment is credited towards the total price.

3. Price and payment

The proposal or contract states the scope, price, travel costs, deadlines and payment schedule. Approved extra hours, products or services are charged separately. Delivery may be withheld until all due amounts are paid.

4. Changes and cancellation

Tell the photographer about a change or cancellation promptly. The contract sets any cancellation charge according to notice and costs already incurred. A wedding reservation payment is normally refundable if cancellation is notified at least 5 months before the wedding. A replacement date is subject to availability.

5. Cooperation and creative approach

The client secures permissions and provides the schedule, venue restrictions and important people or moments. Light, weather, timing and participants affect the result. The photographer works in the documentary style shown in the portfolio and is not responsible for moments impossible to capture due to circumstances beyond reasonable control.

6. Selection and delivery

The photographer selects and edits the final images. RAW or unedited files are not supplied unless agreed in writing. JPG files are delivered through a private online gallery and, if included, on physical media or in print. The proposal or contract states quantity, scope, resolution and delivery deadline.

7. Copyright and publication

Copyright remains with the photographer. Clients receive personal, non-commercial use rights and may share the delivered images without altering their character. Commercial use, resale or supplier advertising requires a licence. Recognisable people are shown in the photographer’s portfolio only with separate consent.

8. Complaints

Describe any defect promptly by email. Consumer complaints are confirmed and resolved without undue delay and no later than 30 days unless otherwise agreed. Mandatory consumer remedies are unaffected. A difference from subjective expectations is not by itself a defect if the work matches the agreement and displayed creative style.

9. Consumer withdrawal

Where a consumer contract is concluded at a distance or off premises and no statutory exception applies, the consumer may withdraw without reason within 14 days. Service may begin during that period only at the consumer’s express request; on withdrawal the proportionate value already provided is payable, and the right may be lost after full performance where statutory conditions are met. Any exception for a service tied to a specific date will be expressly disclosed before contracting.

Model notice: “I hereby withdraw from the photography service contract concluded on [date] for [event/date]. Consumer name and address, date and signature (paper notices only).” Send it to the provider’s address or foto@kubaplsekfoto.cz.

10. Force majeure and liability

For serious illness, accident, natural event, official restriction or another unforeseeable obstacle, the parties will seek a replacement date or fair solution. Mandatory consumer rights and liability that cannot legally be limited remain unaffected.

11. Dispute resolution and law

Contact the photographer first. Consumers may submit an unresolved service dispute to the Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Prague 2, adr@coi.gov.cz, coi.gov.cz/informace-o-adr. Czech law applies without depriving consumers of mandatory protection in their country of residence. The contract language is Czech unless agreed otherwise.
